RESUMEN El objetivo general de la investigación fue analizar la Justicia comunal en contextos rurales andinos: El caso de Alpamayo en Áncash, Perú. El método, se basó en el enfoque cualitativo, manejando la recolección y análisis de una tipología documental-bibliográfica, lo cual permitió organizar un análisis del objeto de estudio con la intención de descubrir el propósito presentado por los investigadores. Además, se utilizó el método de investigación jurídica integrativa, el cual se basó en el pensamiento holístico, que busca entender el objeto de estudio como una totalidad. En la fase de campo, se llevó a cabo entrevistas semiestructuradas con 10 miembros de la comunidad de Alpamayo. Se concluye que, la justicia comunal en Alpamayo, sustentada en el derecho consuetudinario, representa una forma válida de pluralismo jurídico en Perú. La cooperación entre la comunidad campesina, la ronda campesina y el juez de paz establece un sistema organizado y eficaz.
ABSTRACT The general objective of the research was to analyze communal justice in rural Andean contexts: The case of Alpamayo in Ancash, Peru. The method was based on the qualitative approach, managing the collection and analysis of a documentary-bibliographic typology, which allowed us to organize an analysis of the object of study with the intention of discovering the purpose presented by the researchers. In addition, the integrative legal research method was used, which was based on holistic thinking, which seeks to understand the object of study. In the field phase, semi-structured interviews were conducted with ten members of the Alpamayo community. It is concluded that communal justice in Alpamayo, based on customary law, represents a valid form of legal pluralism in Peru. The cooperation between the peasant community, the peasant patrol and the justice of the peace establishes an organized and effective system.
