Resumen de Caminhos para a inclusão: uma análise das políticas de cotas para ingresso em ensino superior (Lei n.º 12.711/2012 e Lei 14.723/2023)

  The work at hand consists of an analysis of the exegesis of the affirmative action concerning the Quota Law for admission to higher education, Law 12,711/2012, and its amendment by Law 14,723/2023, this being a fundamental instrument to promote equality and the inclusion of historically marginalized groups. To this end, firstly, Law No. 12,711/2012 will be dissected in its form prior to the amendment, and then the changes brought about by Law 14,723/2023 will be analyzed. Next, the aim is to synthesize the main criticisms made of Law 12,711/2012 in over 10 years of its existence, and what has or has not been done to address them through Law 14,723/2023. The study consists of an exploratory research: in order to enable a qualitative methodological investigation of the data, the chosen approach was bibliographical research: doctrines, jurisprudence, articles, data from the Brazilian Institute of Geography and Statistics (IBGE), and other sources capable of producing the expected results were analyzed

  O trabalho em tela consiste em uma análise da exegese da ação afirmativa referente a Lei de Cotas para ingresso no ensino superior, a Lei 12.711/2012, e sua alteração pela Lei 14.723/2023, instrumento este fundamental para promover a igualdade e a inclusãode grupos historicamente marginalizados. Para tanto, destrinchar-se-á, primeiramente, a Lei n.º 12.711/2012, na sua forma anterior à alteração, para, após, analisar as mudanças trazidas pela Lei 14.723/2023. Em seguida, pretende-se sintetizar as principais críticas feitas à Lei 12.711/2012 nesses mais de 10 anos de sua vigência, e o que foi ou não foi feito para saná-las por meio da Lei 14.723/2023. O estudo consiste em uma pesquisa exploratória: a fim de possibilitar uma investigação metodológica qualitativa dos dados e o delineamento optado foi o de pesquisa bibliográfica: foram analisados doutrinas, jurisprudências, artigos, dados do Instituto Brasileiro de Geografia e Estatística (IBGE), e demais fontes aptas a produzir os resultados esperados
