On the basis of the recent developments taking place in the Spanish legislation, the Author analyses the role played by labour law. Labour law can be geared to the protection of workers' rights or to the increasing of employment. In the Author's opinion, the traditional scope of labour law has to be maintained, even if con-flicts with the necessity of improving the occupational level should be, as far as possible, avoided
