In the Author's opinion labour law has to be re-shaped in or-der to maintain its role. The reasons for the decline of labour law are genetic. There in fact exists a natural conflict between labour law and the economic system. Scholars, on their side, understand that an integration between labour law and economics in needed. Accordingly to the Author's view, the labour law system has to take into consideration the problem of unemployment. To be in employment is no longer the only way to take part to the commu-nity. The systems of social protection, therefore, are expected to be based upon the absence of work in the market rather than on models built on work
