El derecho de rectificación es un derecho incorporado al ordenamiento jurídico español a través de la Ley Orgánica 2/1984. Allí queda definido como el derecho que toda persona tiene a rectificar la información difundida por cualquier medio de comunicación social de hechos que le aludan, considere inexactos y cuya divulgación pueda perjudicarle. La jurisprudencia del Tribunal Constitucional ha entendido que se trata de un derecho instrumental para el desarrollo y ejercicio del derecho fundamental al honor y, de manera significativa, del derecho a la información. Las transformaciones operadas por la esfera digital en el ámbito comunicativo plantean la necesidad de adaptar la regulación a la realidad contemporánea. En esa línea, aquí se presenta la novedad que supuso incorporar un derecho de rectificación en Internet en 2018. También se analiza lo que la Carta de Derechos Digitales de 2021 supuso como elemento de reflexión en este campo. Finalmente, se atiende al actual Proyecto de Ley Orgánica del Derecho de Rectificación, valorando si sus contenidos pueden ser capaces de cumplir con el reto de hacer efectivo el derecho en las circunstancias actuales.
The right of rectification is a right incorporated into the Spanish legal system through Organic Law 2/1984. It is defined there as the right that every person has to rectify information diffused by any social communication medium regarding facts that refer to them, that they consider inaccurate, and whose dissemination may harm them. The jurisprudence of the Constitutional Court has understood that this is an instrumental right for the development and exercise of the fundamental right to honour and, significantly, the right to information. The transformations brought about by the digital sphere in the communicative field raise the need to adapt regulation to contemporary reality. In this way, the novelty introduced by the incorporation of a right of rectification on the Internet in 2018 is presented here. The analysis also covers the role of the 2021 Charter of Digital Rights as an element of reflection in this field. Finally, attention is given to the current Draft of the Organic Law on the Right of Rectification, assessing whether its contents can meet the challenge of making the right effective under current circumstances.
