The article analyzes the relevance of Natural Law in contemporary times from the perspective of Niklas Luhmann's systemic theory. Using Aristotle's conceptions of natural and legal justice, and Sophocles' tragedy "Antigone", it explores the conflict between divine and human laws. It argues that, in modern society, Law functions as an autopoietic and self-referential system, where Natural Law is incorporated into legal operations. In the end, it is concluded, however, that Natural Law does not guarantee normative expectations and is averse to the evolution required by current positive Law
O artigo analisa a relevância do Direito Natural na contemporaneidade sob a perspectiva da teoria sistêmica de Niklas Luhmann. Utilizando as concepções de Aristóteles sobre justiça natural e legal, e a tragédia "Antígona" de Sófocles, explora o conflito entre leis divinas e humanas. Argumenta que, na sociedade moderna, o Direito funciona como um sistema autopoiético e autorreferencial, onde o Direito Natural é incorporado nas operações jurídicas. Ao fim, conclui-se, no entanto, que o Direito Natural não assegura as expectativas normativas e é avesso à evolução exigida pelo Direito positivo atual
