The protection of human rights in the Americas is strengthened by the Inter-American System for the Protection of Human Rights, which includes the Inter-American Commission on Human Rights (IACHR) and the Inter-American Court of Human Rights (IACHR). This system seeks to protect and promote human rights in regions marked by inequalities and authoritarian histories. However, the recommendations and decisions of the bodies of the Inter-American System for the Protection of Human Rights face barriers to effective implementation in Brazil, where high rates of sexual violence against Yanomami children and adolescents persist in the Waikás region, in the state of Roraima (RR), Brazil. Thus, this research is justified by the need to examine the challenges in the effective application of inter-American standards in the context of sexual violence against these traditional peoples and to propose possible measures to mitigate this problem. This study aims to analyze the performance of the Inter-American System for the Protection of Human Rights in the effective protection of Yanomami children and adolescents in the Waikás region, in Roraima, with a focus on preventing and combating sexual violence. The research, which is basic in nature and has a qualitative approach, uses technical and bibliographical procedures to analyze documents and reports from the Inter-American Commission and Court of Human Rights, as well as academic literature, with the aim of describing the functioning of these bodies and explaining the challenges in implementing their recommendations in Brazil. The study focuses especially on institutional responses to sexual violence against indigenous children, highlighting the importance of the Inter-American System as a mechanism for international pressure in the face of the omission and ineffectiveness of the Brazilian State.
A proteção dos direitos humanos no continente americano é fortalecida pelo Sistema Interamericano de Proteção dos Direitos Humanos de Direitos Humanos, que engloba a Comissão Interamericana de Direitos Humanos (CIDH) e a Corte Interamericana de Direitos Humanos (Corte IDH). Este sistema busca proteger e promover os direitos humanos em regiões marcadas por desigualdades e históricos autoritários. No entanto, as recomendações e decisões dos órgãos do Sistema Interamericano de Proteção dos Direitos Humanos enfrentam barreiras para implementação efetiva no Brasil, onde persistem altos índices de violência sexual contra crianças e adolescentes Yanomami na região de Waikás, no estado de Roraima (RR), Brasil. Assim, essa pesquisa se justifica pela necessidade de examinar os desafios na aplicação efetiva das normas interamericanas no contexto da violência sexual contra esses povos tradicionais e propor possíveis medidas que atenuem esse problema. Este estudo objetiva analisar a atuação do Sistema Interamericano de Proteção dos Direitos Humanos na efetiva proteção das crianças e adolescentes Yanomamis na região de Waikás, em Roraima, com foco na prevenção e combate à violência sexual. A pesquisa, de natureza básica e com abordagem qualitativa, utiliza procedimentos técnico-bibliográficos para analisar documentos e relatórios da Comissão e da Corte Interamericana de Direitos Humanos, além de literatura acadêmica, com o objetivo de descrever o funcionamento desses órgãos e explicar os desafios na implementação de suas recomendações no Brasil. O estudo foca especialmente nas respostas institucionais à violência sexual contra crianças indígenas, evidenciando a importância do Sistema Interamericano como mecanismo de pressão internacional diante da omissão e ineficácia do Estado brasileiro
