En esta resolución, el Tribunal Constitucional nos plantea un caso en el cual vemos en una posición contrapuesta el deber de aplicar las normas procesales de forma rigurosa, por un lado, y la protección jurídica al interés del menor, que ostenta una categorización especial como superior al de los demás ciudadanos, por el otro. A través de las páginas, el documento nos sitúa ante unos hechos del todo peculiares que no fueron previstos por el legislador y que configuran una situación límite en la que adoptar una decisión es ciertamente complicado. Por lo tanto, se hace necesario analizar en primer lugar la tutela judicial efectiva y algunos elementos relacionados como la legitimidad activa a fin de determinar si hubo en primera instancia alguna forma de justificación subyacente a la acción de los tribunales. También, y de forma separada cabe hablar sobre la protección del interés del menor y sus consecuencias, extensamente recogidos en la doctrina del tribunal y en la legislación internacional a fin de entender el fallo del Tribunal Constitucional en nuestra sentencia.
In this ruling, the Constitutional Court presents a case in which two opposing positions are at issue: on the one hand, the duty to apply procedural rules in a strict manner, and on the other, the legal protection of the best interests of the child, which enjoys a special status superior to that of other citizens. Throughout its pages, the document places us before a set of highly unusual circumstances that were not foreseen by the lawmakers and that give rise to an extreme situation in which adopting a decision becomes particularly complex. Therefore, it is necessary first to examine the right to effective judicial protection and certain related elements, such as legal standing, to determine whether, at first instance, there was any underlying justification for the actions of the courts. In addition, and separately, it is appropriate to address the protection of the child’s best interests and its consequences, which are extensively developed both in the Court’s jurisprudence and in international legislation, to understand the Constitutional Court’s reasoning in the present judgment
