En la recientemente creada doctrina del Tribunal Constitucional en relación con las vacunas, una sentencia sirve de apoyo para asentar de forma definitiva la materia. Los magistrados se pronuncian sobre el dilema entre interés superior del menor y la decisión de los progenitores como representantes legales, estableciendo que el interés del menor impera sobre todos los demás factores en materia de vacunas, y que la representación parental no es ilimitada, reafirmando el canon de constitucionalidad creado por el tribunal en sentencias previas.
In the recently created doctrine by Spain’s Constitutional Court regarding vaccination matters, a new ruling of the Constitutional Court serves as support to settle the subject entirely. The magistrates position themselves about the dilemma regarding the minor’s superior interest and the parents’ decision as legal representatives, establishing finally that the minor’s interest is above every other factor regarding vaccines, and parental authority and legal representation is not unlimited, reaffirming the constitutional canon created by the court in previous rulings
