The STJUE ruling of January 18, 2024, marked a turning point regarding the termination of employment contracts due to total, absolute, or severe permanent disability under article 49.1.e) of the Workers' Statute. Terms such as "reasonable adjustments" and "excessive workload," previously associated with disability, are now applied to situations of permanent incapacity. This commentary will address how both the company and the employee should proceed when the latter is declared permanently incapacitated after the entry into force of Law 2/2025 of April 29. The legislator took the opportunity to amend the General Social Security Law, tightening the rules on the compatibility of permanent disability pensions with work, even after reasonable adjustments have been made.
