Propuesta de Recurso ante la Dirección General de Seguridad Jurídica y Fe Pública contra la calificación negativa de la inscripción de nacimiento de los nacidos en el extranjero mediante gestación por sustitución

    La Dirección General de Seguridad Jurídica y Fe Pública (DGSJFP), órgano dependiente del Ministerio de Justicia del Gobierno de España, dictó el 28 de abril de 2025, una Instrucción sobre actualización del régimen registral de la filiación de los nacimientos mediante gestación por sustitución. A través de dicha Instrucción se deroga la normativa anterior emanada del propio Centro Directivo; se impide la aplicación de los mecanismos de validez extraterritorial de decisiones extranjeras en España a las decisiones en materia de filiación de nacidos mediante gestación por sustitución procedentes de otros Estados; y se impone la obligación a los ciudadanos de reconstruir en nuestro país la filiación ya determinada en el extranjero. Los objetivos perseguidos por la mencionada Instrucción chocan frontalmente, sin embargo, con algunos de los principios más elementales del ordenamiento jurídico español. Existen fundamentos de Derecho más que suficientes para sustentar un recurso ante las autoridades competentes contra la mencionada Instrucción. Este trabajo se limita a esgrimir, de conformidad con el ordenamiento jurídico español, algunos de ellos.

    The Dirección General de Seguridad Jurídica y Fe Pública (DGSJFP), a body dependent on the Ministry of Justice of the Government of Spain, issued an Instruction on updating the registration regime for the parentage of births through surrogacy on April 28, 2025. This Instruction repeals the previous regulations issued by the same governing body; it prevents the application of the mechanisms for extraterritorial validity of foreign decisions in Spain to decisions on parentage of children born through surrogacy originating in other States; and it imposes the obligation on citizens to reconstruct in Spain the parentage already determined abroad. The objectives pursued by the aforementioned Instruction clash head-on, however, with some of the most basic principles of the Spanish legal system. There are more than sufficient legal grounds to support an appeal against the aforementioned Instruction. This work is limited to arguing, in accordance with the Spanish legal system, some of them.
