This paper analyzes the statement made by U.S. Secretary of Homeland Security Kristi Noem during a hearing at the Senate Homeland Security Committee, when she stated that Habeas Corpus was the "right to deport." It argues that this statement, far from being an isolated error, clearly distorts its constitutional meaning and highlights a rhetoric of misinformation that seeks to normalize practices that violate human rights. Through bibliographical and qualitative research, the article demonstrates how the case is a symptomatic example of the political exploitation of legal language as an attempt to legitimize authoritarian behavior.
O presente artigo analisa a declaração da Secretária de Segurança Interna dos Estados Unidos, Kristi Noem, durante audiência no Comitê de Segurança Interna do Senado, ao afirmar que o Habeas Corpus seria o “direito de deportar”. É argumentado que a fala, longe de ser um erro isolado, representa evidente distorção de seu significado constitucional, além de destacar uma retórica de desinformação que almeja a naturalização de práticas violadoras de direitos humanos. Mediante pesquisa bibliográfica e qualitativa, demonstra-se como o caso é exemplo sintomático da instrumentalização política da linguagem jurídica como tentativa de legitimar condutas autoritárias.
