El uso de la Inteligencia Artificial (IA) en los conflictos armados es un nuevo paradigma determinar del rol que tienen las empresas implicadas en la creación, desarrollo y suministro de esta tecnología con fines militares a favor de los Estados. En ese contexto, es pertinente analizar a través del marco jurídico internacional si los empresarios tienen responsabilidades que surjan del uso de la IA en la guerra, especialmente por el incumplimiento a los principios y normas del Derecho Internacional Humanitario (DIH).
De conformidad, esta investigación está centrada en establecer si desde la posición de dirigencia de quienes componen el organigrama de empresas de tecnología militar, y permiten que se utilice la IA de forma contraria a lo establecido en el DIH, se puede incurrir en la comisión de crímenes de guerra que puedan ser investigados y juzgados por la Corte Penal Internacional (CPI), a partir de la aplicación de la extensión de la responsabilidad penal. Lo anterior, indicando los límites jurídicos a los que se vería enfrentada su aplicabilidad.
The use of Artificial Intelligence (AI) in armed conflicts is a new paradigm to determine the role of companies involved in the creation, development, and supply of this technology for military purposes in favor of the States. In that context, it is pertinent to analyze, through the international legal framework, whether businesspeople have responsibilities arising from the use of AI in war, especially due to the non-compliance with the principles and norms of International Humanitarian Law (IHL).
Accordingly, this research is focused on establishing whether from the leadership position of those who make up the organizational structure of military technology companies and allow AI to be used in ways contrary to what is established in IHL, it is possible to incur the commission of war crimes that may be investigated and prosecuted by the International Criminal Court (ICC), through the application of the extension of criminal responsibility. The above indicates the legal limits to which its applicability would be confronted.
