A partir de la reforma constitucional de 2011 existen diversos elementos que son necesarios profundizar, como es el reconocimiento de la calidad de víctima de violaciones a derechos humanos. Al respecto, la Suprema Corte de Justicia de la Nación ha considerado el cuidado activo que recibe la víctima directa tanto antes como después del hecho victimizante a fin de reconocer la calidad de víctima indirecta.
