El trabajo de niños, niñas y adolescentes en Colombia cuenta con una sólida protección legal y constitucional, destinada a garantizar sus derechos fundamentales. Aunque el ordenamiento jurídico prohíbe el trabajo infantil que afecte la dignidad o el desarrollo integral, se permite que los adolescentes trabajen en condiciones reguladas y seguras, siempre que no interfieran con su educación, salud o recreación. El artículo expone cómo la Corte Constitucional ha fortalecido este marco mediante una jurisprudencia que armoniza la realidad social del país con los estándares internacionales, especialmente los establecidos por los convenios 138 y 182 de la OIT y otros tratados de derechos humanos. Asimismo, la influencia del Sistema Interamericano y Europeo de Derechos Humanos ha consolidado el principio del interés superior del menor. En conclusión, se resalta la importancia de equilibrar la protección integral de los menores trabajadores con las condiciones socioeconómicas, a través del impulso de políticas públicas que prevengan el trabajo infantil nocivo y promuevan su desarrollo integral.
Child and adolescent labor in Colombia is protected by a solid legal and constitutional framework aimed at guaranteeing their fundamental rights. Although the legal system prohibits child labor that affects dignity or integral development, adolescents may work under regulated and safe conditions, provided this does not interfere with their education, health, or recreation. The article explains how the Constitutional Court has strengthened this framework through jurisprudence that harmonizes the country’s social reality with international standards, especially those established by ILO Conventions 138 and 182 and other human rights treaties. Likewise, the influence of the Inter-American and European Human Rights Systems has consolidated the principle of the child’s best interest. In conclusion, the importance of balancing the comprehensive protection of young workers with socioeconomic realities is emphasized, promoting public policies that prevent harmful child labor and foster personal and family development within a human rights-based approach.
