El Tribunal Supremo, en casación para la unificación de doctrina, considera que el error del órgano gestor en la calificación de la modalidad de jubilación anticipada no debe erigirse en obstáculo para el acceso al complemento por aportación demográfica. La firmeza de la resolución administrativa declarativa de la modalidad de jubilación no puede convertirse en cortapisa para el reconocimiento de dicho derecho cuando los requisitos materiales concurrían efectivamente en el interesado.
The Supreme Court, in appeal to unify conflicting caselaw, holds that the error committed by the public administration managing body in classifying the applicable modality of early retirement should not operate as an obstacle to accessing the demographic contribution supplement. The finality of the administrative decision determining the retirement modality cannot become a barrier to the recognition and enjoyment of that benefit when its material requirements were, in fact, met by the claimant.
