El presente trabajo centra su análisis, de un modo preliminar, en el enfoque teórico del constitucionalismo jurídico y político, especialmente en la doctrina desarrollada en el derecho comparado y sus repercusiones en la doctrina nacional. Este estudio previo del constitucionalismo, lo vincularemos con la propuesta constitucional de 2022 y las influencias ideológicas que tuvieron, en definitiva, preponderancia. Para ello, haremos un análisis centrado principalmente en la propues ta de sistema político, a fin de circunscribir dicha temática dentro del marco teórico que motiva el presente estudio. Como tercer gran asunto, se abordará sucintamente el proceso constituyente de 2023, centrado en los dos grandes órganos encargados de elaborar la propuesta constitucional (Comisión Experta y Consejo Constitucional), que no pudieron en última instancia hacer confluir el consenso técnico y el consenso político que los inspiró. Finalmente, plantearemos las principales conclusiones del trabajo, las que contendrán una visión crítica de los frustrados procesos de 2022 y de 2023 (cuestión inédita a nivel comparado).
The present work focuses its analysis, in a preliminary way, on the theoretical approach of Legal and Political Constitutionalism, especially on the doctrine developed in comparative law and its repercussions in national doctrine. This preliminary study of constitutionalism, we will link it with the Constitutional Proposal of 2022 and the ideological influences that had ultimately preponderance. We will analyse the proposed political system in order to circumscribe this subject within the theoretical framework that is the basis of this study. And as a third major issue, the 2023 Constituent Process will be briefly addressed, focusing on the two main bodies responsible for preparing the constitutional proposal (Expert Commission and Constitutional Council), which ultimately failed to bring together the technical consensus and political consensus that inspired them. Finally, we will present the main conclusions of the work, which will contain a critical vision of the failed processes of 2022 and 2023 (an unpublished issue at comparative level).
