El presente trabajo analiza la fuga de prisión del conocido político neoyorquino William Magear Tweed encarcelado en los Estados Unidos por delitos de corrupción, su huida a España, y posterior captura y extradición por las autoridades españolas. El evento dará opción a examinar las consecuencias de la provechosa transversalidad entre el Derecho y la Literatura ya que combina un proceso judicial con las viñetas satíricas de publicaciones periodísticas del siglo XIX. Las viñetas del dibujante Thomas Nast cumplieron una función jurídica al evidenciar e interpretar la actuación corrupta del político, y finalmente también facilitaron su captura y prisión. Las viñetas de Nast actúan como “exposición de los hechos” hacia la sociedad, creando una labor de concienciación a los lectores que devienen jueces competentes. La literatura asume la función de recuperación de la verdad ya que el receptor lee el texto gráfico y adquiere la facultad y la libertad de emitir un veredicto creando lo que podemos llamar “Sentencias Literarias”.
This essay analyzes the prison escape of the well-known New York politician William Magear Tweed. Imprisoned in the United States for corruption crimes, he fled to Spain and was captured and extradited by Spanish authorities. The event offers the opportunity to examine the consequences of the beneficial intersection between Law and Literature, as it combines a legal process with the satirical cartoons of 19th-century publications. Cartoons by artist Thomas Nast played a legal role in the whole process by exposing the corrupt actions of the politician, and ultimately facilitated his capture in Spain and imprisonment back in the US. Nast’s cartoons functioned as a “statement of the facts” to society, raising awareness among readers who then become competent judges. Literature takes on the role of showing and recovering the truth, as the reader interprets the graphic text and gains the ability and freedom to issue a verdict creating what we can call “Literary Precedent”.
