El presente trabajo tiene por objeto analizar el proyecto de ley de modificación del régimen de responsabilidad patrimonial del Estado legislador por infracción del derecho de la Unión Europea, que se halla actualmente en tramitación parlamentaria, y cuya finalidad es solventar las infracciones del principio de eficacia sancionadas por la Sentencia de 28 de junio de 2022 del Tribunal de Justicia de la Unión Europea. Entreveremos previamente la evolución legislativa y jurisprudencial en esta materia, destacando el relevante quehacer interpretativo realizado por el Tribunal Supremo.
This paper aims to analyze the draft bill amending the regime of state liability for legislative acts that infringe European Union law, which is currently undergoing parliamentary review. Its prupose is to address the breaches of the principle of effectiveness sanctioned by the Judgment of june 28, 2022, of the Court of Justice of the European Union. We will also first examine the legislative and jurisprudential developments in this area, highhlighting the significant interpretative work carried out by the Suprem Court.
