La sentencia del Tribunal de Justicia de la Unión Europea, Sala Séptima, de 19 de diciembre de 2024 (asunto Loredas, C-531/23), ha dado respuesta a la cuestión prejudicial planteada por el Tribunal Superior de Justicia del País Vasco, relativa al registro de jornada laboral en el trabajo doméstico.
El TJUE ha declarado contraria, a la Directiva 2003/88/CE y la Carta de Derechos Fundamentales de la Unión Europea, la normativa española, la interpretación jurisdiccional y la práctica administrativa basada en la misma, en virtud de las cuales los empleadores domésticos están exentos de la obligación de fijar un sistema de registro de jornada laboral para las personas empleadas del hogar.
El TJUE concluye que dicha exención es incompatible con la normativa comunitaria citada, ya que imposibilita a los trabajadores domésticos disponer de un sistema objetivo de control horario, vulnerando sus derechos laborales en materia de tiempo de trabajo.
En consecuencia, la sentencia declara que es necesaria la existencia de un sistema de registro de jornada en este sector
The Judgment of the Court of Justice of the European Union, Seventh Chamber of 19 of December 2024 (case Loredas, C-531/23), has given response to a preliminary question raised by the High Court of Justice of the Basque Country, Spain, regarding the registration of working hours in domestic employment.
The CJEU has contrary declared, to the Directive 2003/88/EC and the Charter of Fundamental Rights of the European Union, the Spanish legislation and its jurisdictional interpretation or administrative practice based on that legislation, under which domestic employers are exempt the obligation to establish a working day registration system by domestic workers.
The CJEU concludes that such an exemption is incompatible with community regulations cited, as it precludes them to provide of an objective system for working time, violating their labor rights working time limitations. Consequently, the Judgment declares it is necessary to have a working time registration system in this sector.
