La Asamblea General de la Organización de las Naciones Unidas adoptó el 7 de diciembre de 2022 un instrumento internacional, con la recomendación de ser conocido como la "Convención de Beijing sobre la Venta Judicial de Buques", que permite la eficacia transfronteriza de los títulos limpios de propiedad sobre buques producto de una venta judicial. La Convención establece un régimen uniforme para dotar de efectos internacionales a la venta judicial de un buque realizada en un Estado parte, dentro de cuyo territorio el buque se encuentre físicamente en el momento de esa venta, cuya ley confiera al comprador un título de propiedad limpio y sujeto al procedimiento de venta judicial establecido por la ley del Estado de la venta judicial. El régimen uniforme se articula en torno a un certificado de venta judicial expedido después de la notificación de la venta judicial por realizar al Estado del registro y a las partes afectadas que consten inscritas y de la transmisión de tal notificación a un archivo en línea a cargo de la Organización Marítima Internacional. La Convención de Beijing tiene así el potencial de impulsar el comercio marítimo internacional al optimizar el precio de venta de los buques en ventas judiciales, por la certeza de la eficacia transfronteriza de la venta judicial en beneficio de los compradores, y con ello salvaguardar los derechos de los titulares de créditos con privilegio marítimo que serán pagados con el producto de la venta judicial.
On December 7, 2022, the General Assembly of the United Nations adopted an international instrument, with the recommendation to be known as the "Beijing Convention on the Judicial Sale of Ships", which allows the crossborder effectiveness of clean title to ships resulting from a judicial sale.
The Convention establishes a uniform regime for giving international effect to the judicial sale of a ship in a State Party, within whose territory the ship is physically present at the time of the sale, the law of which confers on the buyer a clean title of ownership and subject to the judicial sale procedure established by the law of the State of judicial sale. The uniform rules are structured around a judicial sale certificate issued after notification of the judicial sale to be made to the State of registration and to the registered affected parties and the transmission of that notification to an online file maintained by the International Maritime Organization. The Beijing Convention thus has the potential to boost international maritime trade by optimizing the sale price of ships in judicial sales, by the certainty of the cross-border effectiveness of judicial sales for the benefit of buyers, and thereby safeguarding the rights of creditors with maritime liens that will be paid with the proceeds of the judicial sale.
