El trabajo es uno de los aspectos fundamentales de la vida y por tanto, la pérdida del mismo puede suponer un perjuicio enorme para el trabajador. Ante un tema de tanta relevancia, en el presente estudio se abordará la forma en que el trabajador puede impugnar la extinción de la relación laboral por parte unilateral del empresario: el proceso por despido disciplinario. En el mismo se analizarán las características propias de la demanda de despido y el breve plazo con el que cuenta el trabajador para interponer la reclamación por despido, así como las particularidades que existen en el acto del juicio en el proceso por despido. Por otro lado, se analizará las posibles calificaciones que puede hacer el juez del despido en la sentencia, los supuestos y consecuencias de los mismos, así como todo lo relativo a la ejecución y los medios de impugnación de la sentencia recogidos legalmente. . Del análisis realizado, se ha obtenido información sobre la situación actual del despido, tanto a nivel nacional como internacional, así como el impacto que han tenido las diferentes reformas, leyes y sentencias dictadas recientemente por los tribunales españoles en la aplicación de dicho proceso.
Work is one of the fundamental aspects of life and therefore, the loss of it can mean enormous harm to the worker. Faced with such a relevant issue, this study will address the way in which the worker can challenge the termination of the employment relationship by the employer's unilateral action: the disciplinary dismissal process. It will analyze the characteristics of the dismissal claim and the short period of time that the worker has to file the claim for dismissal, as well as the particularities that exist in the act of trial in the dismissal process. On the other hand, the possible qualifications that the dismissal judge can make in the sentence will be analyzed, the assumptions and consequences thereof, as well as everything related to the execution and the legally established means of challenging the sentence. From the analysis carried out, information has been obtained about the current situation of dismissal, both nationally and internationally, as well as the impact that the different reforms, laws and rulings recently issued by the Spanish courts have had on the application of said process.
