El presente artículo pretende visibilizar la falta de acceso efectivo a la protección social de millones de mujeres indígenas en América Latina. De manera específica, al derecho fundamental de la seguridad social y los factores que intervienen en torno a la discriminación por cuestiones de género, etnicidad y su sobre representación en la economía informal. Esta situación, innegablemente genera condiciones para un trato jurídicamente diferenciado en aras de alcanzar la anhelada justicia social en lo que concierne a la protección social bajo un enfoque intercultural, al deslaboralizar la seguridad social a favor de la erradicación de la discriminación estructural.
Cet article vise à rendre visible l’accès effectif à la protection sociale de millions de femmes autochtones en Amérique latine, en particulier le droit fondamental à la sécurité sociale, ainsi que les facteurs qui interviennent autour de la discrimination fondée sur le genre, l’ethnicité et leur sur-représentation dans l’économie informelle. Cela génère indéniablement des conditions pour un traitement juridiquement différencié afin d’atteindre la justice sociale tant désirée en ce qui concerne la protection sociale dans une approche interculturelle, en désengageant la sécurité sociale et en faveur de l’éradication de la discrimination structurelle.
This article aims to make visible the effective access to social protection of millions of indigenous women in Latin America, specifically the fundamental right to social security, and the factors that intervene around discrimination based on gender, ethnicity and their overrepresentation in the informal economy. This undeniably generates conditions for legally differentiated treatment in order to achieve the desired social justice with regard to social protection under an intercultural approach, de-employing social security and in favor of the eradication of structural discrimination.
