    El presente trabajo tiene por objeto el estudio de la noción de “la otra parte contratante”, prevista en los arts. 17 a 19 del RBI bis, la cual, junto con la noción de consumidor, delimita el alcance subjetivo de la competencia en materia de contratos de consumo del RBI bis. Ante la ausencia de una definición precisa, esta noción se construye a partir del concepto de consumidor y de la exigencia de la celebración efectiva de un contrato. Al igual que ocurre con la noción de consumidor, el acervo del Derecho derivado en esta materia constituye una herramienta clave para la interpretación sistemática de dicho concepto, especialmente en los casos en que el consumidor se encuentre vinculado contractualmente, de modo indisociable, a dos cocontratantes.

    The purpose of this paper is to study the concept of "the other party contract" as set out in Articles 17 to 19 of the Brussels l bis Regulation, which, together with the concept of consumer, defines the subjective scope of jurisdiction in consumer contracts under the Regulation. In the absence of a precise definition, this concept is constructed based on the notion of consumer and the requirement that the contract has been effectively concluded. As with the notion of consumer, the body of EU secondary legislation based on directives in this a rea serves as a key too/ far the systematic interpretation of this concept, particular/y in cases where the consumer is contractual/y bound, in an inseparable manner, to two co-contracting parties.
