En el universo mental de los juristas existe una definición más o menos articulada de la expresión “argumentación jurídica”. En este trabajo, sin embargo, se reflexiona sobre una cuestión específica: ¿cuál es el significado de dicha expresión en la jurisprudencia mexicana? Al contrastar los criterios jurisprudenciales analizados con algunos significados paradigmáticos de la expresión objeto de esta investigación, entre otros hallazgos, se observa el pluralismo significativo que tiene en la teoría y en la práctica, pero también se pone de manifiesto el modo en el que su significación teórica se corresponde y se interrelaciona con su uso en la práctica jurisprudencial. Metodológicamente, este trabajo tiene un enfoque cualitativo, abordado desde una perspectiva metajurisprudencial, con el objetivo de dar cuenta del significado de la expresión “argumentación jurídica” en la jurisprudencia mexicana, para ello se utilizan fuentes documentales primarias y secundarias, que incluye libros, artículos y, fundamentalmente, criterios jurisprudenciales que, en el motor de búsqueda del Semanario Judicial de la Federación, fueron filtrados a partir de tres variables: a) frase o palabra de búsqueda: “argumentación jurídica”, b) que ésta esté incluida en: texto y c) que el criterio sea considerado como: jurisprudencia.
In the mental universe of jurists there is a more or less articulated definition of the expression “legal argumentation”. In this paper, however, we reflect on a specific question: what is the meaning of the expression “legal argumentation” in Mexican juris-prudence? By contrasting the jurisprudential criteria analyzed with some paradigmatic meanings of the expression object of this research, among other fin-dings, we observe, on the one hand, the conceptual variants that the expression legal argumentation has in theory and in practice, but, on the other hand, the paper shows the way in which the theoretical sig-nificance of the expression analyzed corresponds to its use in jurisprudential practice. Methodologically, this work has a qualitative approach and its focus from a metajurisprudential perspective, with the ob-jective of explaining the meaning of the expression “legal argumentation” in Mexican jurisprudence, for this purpose primary and secondary documen-tary sources are used, which includes books, articles and, fundamentally, jurisprudential criteria that, in the search engine of the Semanario Judicial de la Federación, were filtered based on three variables: a) search phrase or word: “legal argumentation”, b) that it is included in: text and c) that the criterion be considered as: jurisprudence.Argumentación jurídica, teoría de la argumentación jurídica, jurisprudencia, prácticas argumentativas.
