Este estudio aborda las acciones de filiación (reclamación, impugnación y mixta) y sus especialidades procesales, analizando la tensión entre el derecho a la verdad biológica y la seguridad jurídica. Se examina el control previó de admisión a la demanda de filiación que realizan los tribunales, las especialidades en materia de plazos para ejercitar las acciones, la centralidad de la prueba biológica y el efecto indiciario cualificado de la negativa a practicarla. Finalmente, se analiza la legitimación de herederos y la modulación de la cosa juzgada para garantizar la protección integral del menor.
This study addresses filiation actions (claim, impugnation, and mixed action) and their procedural specialties, analyzing the tension between the right to biological truth and legal certainty. It examines the prior judicial control for the admission of filiation claims, the specific rules regarding time limits for exercising the actions, the centrality of biological proof, and the qualified indicial effect of the refusal to undergo testing. Finally, it analyzes the legitimation of heirs and the modulation of res judicata to guarantee the comprehensive protection of the minor.
