El derecho a la salud, implica recibir atención de los diversos profesionales de la salud que participan en el equipo multidisciplinario, este es un derecho humano porque al mantener el bienestar se procura la dignidad de la persona. La realidad del derecho a la salud es muy diferente a la que se presume en el bloque de regularidad normativa, y esto queda al descubierto con la evidencia jurídica de las sentencias, tesis aisladas y jurisprudencias de los tribunales federales del país. El presente artículo tuvo como objetivo analizar y operacionalizar las implicaciones de la protección del derecho humano a la salud en México. Se realizó una investigación documental, mediante el método análisis-síntesis y hermeneútico. Se concluye que proteger el derecho humano a la salud va más allá de garantizarlo positivamente en las normas, sino que implica cumplir con esta obligación constitucional utilizando todos los recursos y medios sin importar el costo que esto represente.
The right to health implies receiving atenttion from the various health professionals who participate in the multidisciplinary team, this is a human right because maintaining well-being ensures the dignity of the person. The reality of the right to health is very different from what is presumed in the block of normativve regularity, and this is revealed by the legal evidence of the sentences, isolated theses and jurisprudence of the federal courts of the country. The objective of this article was to analyze and operationalize the implications of the protection of the human right to health in Mexico. Documentary research was conducted using the análisis-syntheses and hermeneutic method. It is concluded that protecting the human right to health goes beyond guaranteeing it positively in regulations, it also entails fulfilling this constitutional obligation using all resaurces and means, regardless of the cost.
