The fragment that is the subject of this article is the only surviving part of the third book of Aburnius Valens’s work on the fideicommissum and, according to Lenel’s reconstruction, belongs to the section devoted to the restitution of the fideicommissum hereditatis. The jurist examines, on a case-by-case basis, the problems that could arise between the restitution of an inheritance by fideicommissum and the claims of the creditors; precisely for this reason, he discusses the application of the interdictum fraudatorium.
