En el contexto del homenaje al profesor García de Enterría celebrado en el Real Colegio Mayor de San Clemente de los Españoles y en la Scuola di Specializzazione in Studi sull’Amministrazione Pubblica (SPISA) de la Universidad de Bolonia, con motivo del centenario de su nacimiento en 1923, y con base en firmes convicciones fundamentales del reconocido maestro, se afirma en estas páginas la centralidad jurídica de la libertad, propia y exclusiva de la persona humana, su neta diferencia respecto de la noción de autonomía, y la importancia de su doble relevancia individual y social, ofreciéndose algunas consideraciones críticas sobre los excesos restrictivos y, por otra parte, permisivos que se vienen observando en su ordenación jurídica en los últimos tiempos.
In the context of the homage paid to Professor García de Enterría at the Real Colegio Mayor de San Clemente de los Españoles and the Scuola di Specializzazione in Studi sull’Amministrazione Pubblica (SPISA) of the University of Bologna, on the occasion of the centenary of his birth in 1923, and based on the firm fundamental convictions of the renowned teacher, these pages affirm the legal centrality of free-dom, proper and exclusive to the human person, its clear difference with respect to the notion of autonomy, and the importance of its double individual and social relevance, offering some critical considerations on the restrictive and, on the other hand, permissive excesses that have been observed in its legal ordering in recent times.
