los litigios climáticos parecen constituir actualmente la reacción más eficaz en la actualidad frente a las medidas planteadas y los objetivos adoptados por los Estados en la lucha contra los efectos del cambio climático. Ciudadanos particulares, asociaciones sin ánimo de lucro e incluso municipios discuten la insuficiencia o la ausencia de medidas planteadas por sus Gobiernos nacionales en esta materia. Ejemplos al respecto pueden encontrarse en diversos países de nuestro entorno. El recorrido entre ellos no es mimético, pero sí existe un elemento común a todos ellos, salvo en el caso español: la condena al Gobierno demandado para que adopte medidas adicionales en la lucha contra el cambio climático. Nos encontramos en un momento en el que los Tribunales tanto contencioso- administrativos como constitucionales consideran tener capacidad para dilucidar estas controversias y salen al paso de los posibles argumentos de activismo judicial. Para mostrar esta dinámica, en la que el Poder Judicial se acaba convirtiendo en el garante último de la lucha contra el cambio climático, vamos a comentar lo sucedido en Francia y a señalar cuál es, posiblemente, el siguiente hito en esta materia.
Climate litigation currently appears to be the most effective response to the measures proposed and targets adopted by states in the fight against the effects of climate change. Individual citizens, non-profit organisations and even municipalities are challenging the inadequacy or absence of measures proposed by their national governments in this area. Examples of this can be found in various countries around us. The paths taken are not identical, but there is one element common to all of them, except in the case of Spain: the condemnation of the defendant government to adopt additional measures in the fight against climate change. We are at a point where both contentious-administrative and constitutional courts consider themselves capable of resolving these disputes and are pre-empting possible arguments of judicial activism. To illustrate this dynamic, in which the judiciary is ultimately becoming the guarantor of the fight against climate change, we will comment on what has happened in France and point out what is possibly the next milestone in this area.
