    This research aimed to analyze the current model of instruction of the Administrative Sanctioning Process (PAS) adopted by UNIFAL-MG under Law No. 14,133/2021, in light of existing regulatory gaps, with the purpose of proposing a regulatory model that observes due process and its guarantees. To achieve the proposed objective, the methodological procedure adopted in this study was a bibliographic research, documentary research, and a case study on a PAS instituted by UNIFAL/MG. With the results of the bibliographic and documentary research, it was possible to identify all the articles of the law that deal with the subject of sanctions. Through the case study, it was possible to identify and describe the procedures used in the UNIFAL-MG PAS and respond to the checklist based on Law No. 14,133/2021.

    Essa pesquisa se propôs analisar o modelo atual de instrução do Processo Administrativo Sancionador – PAS adotado pela UNIFAL-MG sob a égide da Lei nº 14.133/2021, à luz das lacunas normativas existentes, com o propósito de propor um modelo normativo que observe o devido processo legal e suas garantias. Para alcançar o objetivo proposto, o procedimento metodológico adotado neste estudo foi uma pesquisa bibliográfica, pesquisa documental e um estudo de caso sobre um PAS instaurado pela UNIFAL/MG. Com o resultado da pesquisa bibliográfica e documental foi possível identificar todos os artigos da lei que tratam sobre o tema sancionatório. Pelo estudo de caso, foi possível identificar e descrever os procedimentos utilizados no PAS da UNIFAL-MG e responder ao checklist feito com base na Lei nº 14.133/2021.
