    En la futura regularización del mercado de cannabis con fines no terapéuticos o recreacionales que, tarde o temprano, deberá afrontar el Estado Chileno, el derecho penal constituye una de sus principales aristas. Pero, antes de detallar en una norma la intervención del derecho penal en este nuevo contexto político, previamente, deberán tenerse presente tres cuestiones fundamentales: la relevancia político criminal de los mercados de cannabis (ilícito, regularizado y, el denominado, mercado gris); las principales conductas que deben criminalizarse; y los mecanismos penales para reparar los daños causados, precisamente, por el propio sistema penal.

    In the future regularization of the recreational cannabis market that, sooner or later, the Chilean State will have to face, criminal law constitutes one of its main aspects. But, before detailing in a rule the intervention of criminal law in this new political context, three fundamental questions must be kept in mind: the political-criminal relevance of cannabis markets (illicit, regularized and, the so-called, gray market); the main behaviors that should be criminalized; and the criminal instruments to repair the damage caused by the penal model.
