El texto presenta una descripción de las dos concepciones dominantes sobre el consentimiento sexual, y que han marcado lo que en la literatura angloamericana se denomina la pregunta por la ontología del consentimiento. Así, se indaga en la perspectiva actitudinal, que lo entiende primariamente como un estado mental, y en la perspectiva performativa, que lo comprende, en cambio, como una comunicación. Ambas posiciones fijan los ejes sobre los que ha girado la discusión en el mundo anglosajón y sobre los que crecientemente se desarrolla, también, la discusión en el plano continental. Aquí se ofrece una breve caracterización de sus notas distintivas y se indaga en su consagración legislativa. Reparar en esta discusión y en las estrategias legislativas asociadas es especialmente útil dado que el auge de los modelos del consentimiento es una realidad indesmentible y ya es posible apreciar en Chile algunas tímidas repercusiones. Aquí se favorece una concepción performativa del consentimiento, bajo el entendido de que permite satisfacer mejor las funciones que está llamado a desempeñar en el esquema del derecho penal sexual.
The text presents a description of the two dominant conceptions of sexual consent, which have shaped what is referred to in Anglo-American literature as the question of the ontology of consent. It explores the attitudinal view, which primarily understands consent as a mental state, and the performative view, which, conversely, understands it as a form of communication. Both positions establish the axes around which the discussion in the Anglo Saxon world has revolved, and upon which the discourse is increasingly developing within the continental framework as well. A brief characterization of their distinctive features is provided, along with an exploration of their legislative acknowledgment. Engaging with this discussion and the associated legislative strategies is particularly beneficial given that the rise of consent models is an undeniable reality, and some tentative repercussions are already observable in Chile. This text favors a performative conception of consent, on the understanding that it better fulfills the functions it is intended to serve within the framework of sexual criminal law.
