El artículo analiza en una perspectiva comparada el tema de la regulación jurídica de las acciones contra el desperdicio alimentario. Prestando especial atención a la dimensión europea y, en términos más sintéticos, también latinoamericana, se reflexionará sobre las principales “tendencias” que han animado las correspondientes legislaciones, analizando algunos actos normativos que sancionan conductas negativas, por un lado, o intentan estimulan y premiar conductas positivas, por el otro. Finalmente, se desarrollarán algunas consideraciones conclusivas sobre las posibilidad de afrontar la cuestión del desperdicio alimentario a través del acceso a la vía judicial y la posibilidad de hacer valer en dicha sede un correspondiente derecho subjetivo.
The article analyses the issue of legal regulation of actions against food waste in a comparative perspective. With a particular focus on Europe and, more briefly, on Latin America, it reflects on the main trends that have shaped some relevant legislations, analysing laws that either sanction negative behaviours or encourage and reward positive actions. Finally, some concluding considerations will be developed on the possibility of addressing the issue of food waste through access to the courts and the possibility of enforcing a corresponding right in that forum.
