El presente trabajo tiene por objeto tratar de demostrar que el certiorari y el recurso de amparo son verdaderamente distintos en cuanto al carácter de su admisión. Con ocasión de este trabajo pueden conocerse las principales diferencias que se encuentran en la admisión de peticiones de certiorari en el modelo estadounidenses y el recurso de amparo español. Se parte de un análisis específico de las pautas procesales principales que sirven de cauce en la Corte Suprema de EE. UU. para terminar aceptando o rechazando las diferentes demandas. Posteriormente, se analizan, como decimos, los puntos coincidentes y divergentes entre este sistema y el español.
This paper aims to demonstrate that the certiorari and the amparo appeal are truly distinct regarding the nature of their admission. Through this study, the main differences between the admission of certiorari petitions in the U.S. model and the Spanish amparo appeal can be identified. The analysis begins with a specific examination of the main procedural guidelines followed by the U.S. Supreme Court when accepting or rejecting the various petitions. Subsequently, as noted, the paper analyzes the points of convergence and divergence between this system and the Spanish one.
