El siguiente artículo tiene como objetivo analizar los factores que inciden en la vulneración del derecho de defensa en la incoación del proceso inmediato, desde un enfoque normativo y jurisprudencial, y las condiciones procesales que afectan la garantía del derecho de defensa durante la etapa de su incoación, a fin de proponer medidas que aseguren su protección efectiva. Esta modalidad procesal, concebida para garantizar la celeridad y eficacia de los procedimientos penales y descongestionar el sistema judicial, ha generado cuestionamientos en torno a su compatibilidad con las garantías fundamentales del imputado, especialmente el derecho de defensa, reconocido tanto por la Constitución Política del Perú como por tratados internacionales de derechos humanos. La metodología aplicada en función del problema y el objetivo de la investigación es un enfoque cualitativo a través de análisis documental, entrevistas semiestructuradas, y de diseño no experimental. Se espera aportar un marco interpretativo garantista que fortalezca el respeto al debido proceso en el sistema penal peruano. Se concluye que la aplicación actual del proceso inmediato, restringe el ejercicio efectivo de la defensa del imputado, debido a las limitaciones de carácter temporal y procesal. Asimismo, se evidencian deficiencias normativas y criterios dispares entre jueces y fiscales. Se propone un enfoque garantista y reformas legales que aseguren el respeto al debido proceso y refuercen la protección de los derechos del imputado en el sistema penal peruano.
The following article aims to analyze the factors that contribute to the violation of the right to defense in the initiation of immediate criminal proceedings, from both a normative and jurisprudential perspective, as well as the procedural conditions that undermine this guarantee during its early stage. Although this procedural mechanism was designed to ensure speed and efficiency in criminal proceedings and reduce judicial backlog, it raises concerns about its compatibility with the fundamental rights of the accused, particularly the right to defense, as recognized by the Peruvian Constitution and international human rights treaties. The study employs a qualitative, non-experimental methodological approach, using documentary analysis and semi-structured interviews. The objective is to contribute a rights-based interpretive framework that strengthens due process in the Peruvian criminal justice system. The findings show that the current implementation of immediate proceedings restricts the effective exercise of the defendant’s right to defense due to time and procedural constraints. Additionally, normative shortcomings and inconsistent criteria among judges and prosecutors are identified. A rights-based approach and legal reforms are proposed to ensure respect for due process and reinforce the protection of defendants’ rights.human rights.
