El 5 de noviembre del presente año 2025 la UNESCO adoptó la Recommendation on the Ethics of Neurotechnology, que ha entrado en vigor el 12 de noviembre. Este instrumento constituye el primer marco internacional que aborda, desde la ética y los derechos humanos, los retos jurídicos y sociales derivados de la neurotecnología. Se analiza su alcance, sus implicaciones para la gobernanza digital y su conexión con los neuroderechos, con referencia al apartado XXVI de la Carta de Derechos Digitales española. Se ofrece una reflexión urgente sobre la necesidad de situar a la persona —y no a la tecnología— en el centro del debate sobre la neurotecnología y su impacto en los derechos fundamentales.
On 5 November 2025, UNESCO adopted the Recommendation on the Ethics of Neurotechnology, which entered into force on 12 November. This instrument is the first international framework to address the legal and social challenges arising from neurotechnology from an ethical and human rights perspective. It analyses its scope, its implications for digital governance and its connection with neurorights, with reference to section XXVI of the Spanish Charter of Digital Rights. It offers an urgent reflection on the need to place the individual —and not technology— at the centre of the debate on neurotechnology and its impact on fundamental rights.
