Este estudio tiene como objetivo analizar el impacto de las modificaciones propuestas de la Ley Orgánica 2/1984 (L.O. 2/1984), presentadas por el gobierno español, sobre la regulación del Derecho de Rectificación y su papel en la lucha contra las fake news en internet. Se ha procedido a realizar un examen exhaustivo y un análisis jurídico detallado del texto preliminar de las modificaciones propuestas por el gobierno español. Los hallazgos indican que estos cambios propuestos representan un hito significativo para la protección judicial de los partidos políticos frente a la desinformación en internet. Las conclusiones destacan la necesidad de reforzar el marco legal para frenar la difusión de noticias falsas y preservar la integridad del proceso democrático.
This study aims to analyze the impact of the proposed amendments to the Spanish Law L.O. 2/1984, presented by the Spanish government, on the regulation of the Right of Rectification and its role in combating fake news on the internet. A review and legal analysis of the draft amendments were conducted. The findings indicate that these proposed changes represent a significant milestone, enhancing judicial protection for political parties against misinformation. The conclusions highlight the necessity of fortifying the legal framework to curb the dissemination of fake news and uphold the integrity of the democratic process.
