La unión y convivencia familiar, bien jurídico protegido por los Instrumentos internacionales y las legislaciones nacionales, está sometida a un riesgo mayor por las circunstancias sociales actuales que influye en la estabilidad familiar. En ocasiones el riesgo proviene de las injerencias de las autoridades públicas. En estas páginas analizamos los estándares de protección de la unión familiar establecidos por el Comité de Derechos Humanos (CDH) y el Comité de los Derechos del Niño (CDN) en sus Observaciones Generales y dictámenes. Entendemos que los Estados que han ratificado el Pacto Internacional de Derechos Civiles y Políticos (PIDCP) y la Convención sobre los Derechos del Niño, y han reconocido las competencias de sus Comités deberían adecuar sus legislaciones internas a dichos estándares en aras de una mayor protección de la familia, elemento fundamental para la sociedad. Sin embargo, el análisis de la realidad nos muestra que estamos lejos de este objetivo.
Family union and coexistence, a legal good protected by international Instruments and national law, is subject to greater risk due to current social circumstances that influence family stability. Sometimes the risk comes from interference by public authorities. In these pages we analyze the standards for the protection of family union established by the Human Rights Committee and the Committee on the Rights of the Child in their General Observations and Views. We understand that States that have ratified the International Covenant on Civil and Political Rights and the Convention on the Rights of the Child, and have recognized the competencies of their Committees, should adapt their domestic legislation to these standards in the interests of greater protection of the family, a fundamental element for society. However, the analysis of reality shows us that we are far from this objective.
