La relación entre la postergación de derechos sociales y la desigualdad es un tema de gran relevancia para América Latina, debido a las afectaciones que genera en el nivel de vida de las personas, sobre todo de quienes integran grupos desaventajados. Por ello, este artículo analiza dicha relación, explora la evolución de la protección constitucional de estos derechos y resalta el rasgo igualitario con el que emergieron, así como las objeciones que han surgido a tal protección. Asimismo, examina la realización de estos derechos en las realidades latinoamericanas y concluye identificando que la existencia de privaciones efectivas de derechos sociales forma parte de un proceso de acumulación histórica de desventajas que generan y reproducen la desigualdad en la región.

The connection between the postponement of social rights and inequality is an issue of great relevance for Latin America, due to the effect it has on people’s standard of living, especially for those who are part of disadvantaged groups. Therefore, this article analyzes this relationship and explores the evolution of the constitutional protection of these rights, underlining the egalitarian feature with which they emerged and the objections that have arisen to their protection. It then examines the realization of these rights in Latin American realities and concludes by identifying that the existence of effective deprivations of social rights is part of a process of historical accumulation of disadvantages that generate and reproduce inequality in the region.
