La Directiva 2024/1203 de 11 de abril, ha vuelto a poner sobre la mesa que la corrupción de funcionarios en el ámbito medioambiental requiere de la atención del Derecho penal y nos permite ahora a través de este trabajo, realizar un análisis general sobre el delito de prevaricación específica en el sector del medio ambiente del art. 329 CP, examinando así sus similitudes y diferencias con la prevaricación ordinaria del art. 404 CP, configurándose como un tipo penal pluriofensivo en el que conviven tanto la protección a la Administración Pública y su adecuado funcionamiento, con la tutela que necesita el medio ambiente frente a sus ataques más graves, en este caso derivados de la actuación de funcionarios que ponen en peligro el bienestar de nuestro entorno.

Directive 2024/1203 of 11 April has brought back to the fore that corruption by public officials in the environmental sphere warrants a criminal-law response and, through this paper, enables a general analysis of the specific offence of Misconduct in public office in the environmental sector under Article 329 of the Criminal Code. The study examines its similarities and differences with ordinary similar crime under Article 404 of the Criminal Code, and frames it as an offence protecting multiple legal interests, in which the protection of the Public Administration and its proper functioning coexists with the protection owed to the environment against its most serious assaults—here, those stemming from the conduct of public officials who put the well-being of our surroundings at risk.
