Este artículo analiza el potencial de la justicia restaurativa como respuesta jurídica ante los delitos medioambientales, con especial atención al ámbito empresarial. A partir del marco normativo internacional, europeo y español, se examinan las limitaciones del sistema penal tradicional y se proponen mecanismos restaurativos centrados en la reparación integral de las víctimas, la participación comunitaria y la transformación institucional. Asimismo, se abordan los retos metodológicos y transnacionales de su implementación, subrayando la necesidad de articular eficazmente justicia penal y restaurativa en el ámbito medioambiental. El trabajo concluye que la justicia restaurativa constituye una vía legítima y transformadora hacia modelos de responsabilidad corporativa más humanos, inclusivos y sostenibles.

This article explores the potential of restorative justice as a legal response to environmental crimes, with particular emphasis on the corporate sphere. Drawing on international, European, and Spanish legal frameworks, it examines the limitations of the traditional criminal justice system and proposes restorative mechanisms focused on comprehensive victim reparation, community participation, and institutional transformation. The article also addresses the methodological and transnational challenges of implementation, highlighting the need for effective articulation between criminal and restorative justice in environmental context. It concludes that restorative justice represents a legitimate and transformative path toward more humane, inclusive, and sustainable models of corporate responsibility.
