La elaboración de una memoria de análisis de impacto normativo (MAIN) en la tramitación de las ordenanzas municipales puede contribuir a mejorar su calidad y al cumplimiento de los principios de buena regulación en el ámbito local. Sin embargo, esta técnica de evaluación previa debe ser adaptada cuando se aplica a las normas municipales. Conviene seleccionar los impactos que se vayan a analizar, graduar la intensidad de su valoración y elegir con cuidado el instrumento que establezca las pautas para la confección de la memoria.
En el caso de Madrid, el Ayuntamiento aprobó en 2018 unas directrices sobre la elaboración de la MAIN, a las que el Tribunal Superior de Justicia ha atribuido carácter normativo y en las que se ha apoyado para anular, total o parcialmente, varias ordenanzas municipales.
The preparation of a regulatory impact analysis report in the processing of municipal bylaws can contribute to improve their quality and compliance with the principles of good regulation at the local level. However, this prior evaluation technique needs to be adapted when applied to municipal regulations. The impacts to be analysed should be selected, the intensity of their assessment should be graded and the instrument that establishes the guidelines for the preparation of the report should be carefully chosen.In the case of Madrid, in 2018 the City Council approved guidelines on the prepara-tion of the analysis report, to which the High Court of Justice has attributed normative nature and on which it has relied to annul, in whole or in part, several municipal bylaws
