The author briefly discusses some issues about interpretation arising from the preceding essays. In particular: the distinction between in abstracto and in concreto interpretation; the distinction between cognitive and adjudicative interpretation; the (twofold) frame of the admissible and, respectively, accepted interpretations; the peculiarities of the reasoning by which unexpressed norms are constructed by legal scholars (and judges).
L’autore discute brevemente alcune questioni di teoria dell’interpretazione emerse nei saggi precedenti. In particolare: la distinzione tra interpretazione in abstracto e in concreto; la distinzione tra interpretazione cognitiva e decisoria; la (duplice) cornice delle interpretazioni ammissibili e, rispettivamente, ammesse; le peculiarità dei ragionamenti mediante i quali i giuristi (e i giudici) costruiscono norme inespresse.
