El TC en su sentencia 87/2024, de 4 de junio se ha pronunciado por vez primera sobre cómo las operaciones encubiertas protagonizadas por agentes encubiertos afectan a los derechos fundamentales de los investigados, determinando que no violentan sus derechos fundamentales. Esta sentencia del TC proporciona el amparo constitucional que necesitaban los policías que, de manera voluntaria, protagonizan estas investigaciones tan complejas y peligrosas, las operaciones encubiertas. Por lo anterior, se trata de una novedad jurisprudencial que tiene una gran repercusión y trascendencia a nivel tanto procesal como social que nos proponemos explicar en estas páginas.
In its decision 87/2024 of 4 June, the TC ruled for the first time on how undercover operations carried out by undercover agents affect the fundamental rights of those under investigation, determining that they do not violate their fundamental rights. This decision of the TC provides the constitutional protection needed by the police officers who, on a voluntary basis, carry out these complicated and dangerous investigations, the undercover operations. Therefore, this is a jurisprudential novelty that has great repercussions and transcendence at both a procedural and social level, which we intend to explain in these pages.
