El presente trabajo busca demostrar que la justicia especializada instaurada en nuestro país para el conocimiento de las controversias ambientales presenta importantes deficiencias tanto en su diseño competencial como en su estructura orgánica, lo que ha impedido maximizar las ventajas propias de la especialización. Esta situación resulta especialmente preocupante si se considera la necesidad de contar con interpretaciones uniformes, técnicamente fundadas y coherentes, que promuevan una mayor observancia y eficacia de las normas ambientales. Asimismo, las interpretaciones jurisprudenciales adoptadas por la Corte Suprema han profundizado esta problemática, en la medida en que han permitido la intromisión de jueces generalistas en decisiones que exigen un alto grado de comprensión jurídica y técnica. Esta apertura tensiona el principio de especialidad que inspira a los Tribunales Ambientales y también genera un escenario de fragmentación interpretativa, debilitando la coherencia del sistema jurídico ambiental y afectando la previsibilidad de las decisiones jurisdiccionales.
This paper aims to demonstrate that the specialized justice system established in Chile for addressing environmental disputes suffers from significant deficiencies in both its jurisdictional design and institutional structure, which have hindered the full realization of the benefits associated with specialization. This situation is particularly concerning given the need for uniform, technically grounded, and coherent interpretations that foster greater compliance with and effectiveness of environmental regulations. Moreover, the jurisprudential interpretations adopted by the Supreme Court have exacerbated this issue by allowing generalist judges to intervene in decisions that demand a high level of legal and technical understanding. This opening not only strains the principle of specialization underlying the Environmental Courts, but also creates a scenario of interpretive fragmentation, thereby weakening the coherence of the environmental legal system and undermining the predictability of judicial decisions.
