    El objetivo del presente trabajo es articular la tutela del discriminado arbitrariamente en el derecho común de contratos chileno tanto en la fase precontractual como en la contractual a partir de la premisa que el hecho discriminatorio es el elemento articulador de tal tutela y que la discriminación arbitraria, al igual que la vulnerabilidad de alguno de los contratantes, es una categoría especialmente tutelable por el derecho de contratos.

    The objective of this work is to articulate the protection of the arbitrarily discriminated in the common law of contracts in both the pre-contractual and contractual phases based on the premise that the discriminatory fact is the articulating element of such protection and that arbitrary discrimination, like the vulnerability of some of the contracting parties, is a category that can be especially protected by contract law.
