Este trabajo indaga en los debates constitucionales en Argentina acerca de la consulta popular no vinculante sobre los términos del Tratado de Paz y Amistad con Chile en 1984. Se abordan las discusiones jurídicas del momento, la sentencia de la Corte Suprema de Justicia sobre la convocatoria y las repercusiones del debate en el contexto de la reforma constitucional de 1994. Además de ampliar el conocimiento sobre estos eventos, el trabajo permite plantear ciertas discusiones sobre el funcionamiento de los tres poderes del Estado en relación con la política exterior y de defensa nacional, a la par que habilita la reflexión sobre la utilización de mecanismos de democracia semidirecta para formar la voluntad estatal en estos asuntos.
This paper examines the constitutional debates in Argentina surrounding the non-binding referendum on the terms of the 1984 Treaty of Peace and Friendship with Chile. It addresses the legal discussions of the time, the Supreme Court of Justice's ruling on the referendum, and the repercussions of the debate within the context of the 1994 constitutional reform. Beyond expanding knowledge of these events, the paper explores the dynamics between the three branches of government in relation to foreign policy and national defense. It also reflects on the use of mechanisms of semidirect democracy to shape state decision-making in matters of foreign policy and national defense.
