El problema suscitado es la determinación del hecho causante de las prestaciones por nacimiento y cuidado de menor, cuando quien la solicita es un progenitor, en el caso el padre, cuya filiación biológica no matrimonial se ha declarado por sentencia firme dictada en el orden jurisdiccional civil con posterioridad al nacimiento, a los efectos de fijar su duración en atención a la normativa aplicable.
