La protección de las personas informantes que denuncian infracciones e irregularidades en materia medio ambiental en el contexto de una relación laboral es un tema de gran interés en la actualidad. La denuncia de las personas trabajadoras se concibe como un instrumento de prevención y de reacción frente a este tipo de conductas en el seno de las organizaciones y empresas. Es necesario contar con un derecho autónomo propio de protección del medio ambiente ante la degradación y el cambio climático. Para abordar este trabajado acudiremos al marco regulador que se ha formulado por el legislador y a pronunciamientos de los tribunales que han entrado a interpretar la norma en respuesta de los conflictos acaecidos. A su vez, un apoyo fundamental es la doctrina que ha estudiado una materia tan necesitada de tutela.
The protection of whistleblowers reporting infringements and irregularities in environmental matters within the context of an employment relationship is a topic of great current interest. The reporting by workers is conceived as an instrument of prevention and reaction against this type of conduct within organizations and companies. It is necessary to have an autonomous legal right for the protection of the environment against degradation and climate change. To address this work, we will refer to the regulatory framework formulated by the legislator and to pronouncements by the courts that have interpreted the law in response to the conflicts that have occurred. In turn, a fundamental support is the doctrine that has studied a matter so in need of protection.
